Terms and Conditions

1. Acceptance of Terms
These Terms and Conditions ("Terms") govern access to and use of Obrital, Inc.'s ("Obrital," "we," "us") website, dashboard, and AI voice receptionist service, including the Lily voice agent (together, the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("you" or "Customer").
2. Description of Service
Obrital provides an AI-powered voice agent that answers, transfers, and acts on phone calls for Customer's business — including bookings, orders, rescheduling, and general enquiries — and syncs the results to Customer's connected systems. The Service is provided on a subscription basis as described on our Pricing page.
3. Account Registration
You must provide accurate business and contact information to register for an account, and you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. Subscription, Billing & Cancellation
- Subscriptions renew automatically each billing period until cancelled.
- New customers may be eligible for a free trial as described at signup; no card is charged until the trial ends unless stated otherwise.
- You may cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period.
- Fees are non-refundable except where required by law or expressly stated in a separate written agreement.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, including telemarketing, robocall, or recording-consent laws;
- Harass, deceive, or defraud callers or third parties;
- Transmit malware or attempt to disrupt or reverse-engineer the Service; or
- Use the Service for a business or purpose other than the one registered on your account.
6. Call Recording & Legal Compliance
Where Obrital records or transcribes calls on your behalf, you are responsible for complying with all applicable telephone-recording, consent, and data-protection laws in the jurisdictions where you and your callers are located, including displaying any required notices to callers. Obrital provides recording-disclosure tooling but is not responsible for a Customer's failure to configure or use it correctly.
7. Third-Party Integrations
The Service may connect to third-party systems (POS, booking, calendar, or practice-management platforms) that you authorize. Obrital is not responsible for the availability, accuracy, or conduct of third-party services, which are governed by their own terms.
8. Intellectual Property
Obrital retains all rights, title, and interest in the Service, including the Lily voice agent, software, and underlying technology. Customer retains ownership of its business data, call recordings, and configuration content, and grants Obrital a license to use it solely to provide and improve the Service.
9. Service Availability
We aim to keep the Service available and responsive at all times but do not guarantee uninterrupted operation. Scheduled maintenance and unplanned outages may occur; any applicable service-level commitments will be set out in a separate agreement for eligible plans.
10. Limitation of Liability
To the maximum extent permitted by law, Obrital will not be liable for indirect, incidental, special, or consequential damages, including lost profits or lost bookings, arising from use of the Service. Our total liability for any claim will not exceed the fees paid by Customer in the three months preceding the claim.
11. Indemnification
You agree to indemnify and hold Obrital harmless from claims arising from your use of the Service in violation of these Terms or applicable law, including claims relating to call recording or consent obligations that were your responsibility under Section 6.
12. Termination
Either party may terminate the Service for convenience at the end of a billing period as described in Section 4. We may suspend or terminate access immediately for material breach of these Terms, including unlawful use of the Service.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Obrital, Inc. is incorporated, without regard to conflict-of-law principles, unless otherwise agreed in writing.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via email or the dashboard and will take effect on the date stated in the notice.
